What Syfted Will and Won’t Do

The plain-language version, before the legal text. If anything here ever conflicts with the numbered Terms below, the numbered Terms control.

We will

  • Be the seller you’re buying from and your single point of contact for every order — one company to deal with, even though your items ship from many independent brands. See Section 4.
  • Process every payment through a PCI-compliant payment provider — Shopify, whose checkout your order goes through. We never see or store your full card number; it stays inside the provider’s systems.
  • Share only the shipping and contact details a brand needs to fulfill your order — never your payment information.
  • Earn you Syfted Points on every order, redeemable for real value on a future purchase. See Section 24.
  • Update this page and tell you plainly when something that affects you changes — how checkout works, what you earn, what you’re charged.

We won’t

  • Charge you anything beyond the total shown at checkout — no hidden fees, no surprise line items, and on an international order no customs bill at the door: import duties and taxes are collected at checkout and paid by us. See Section 6.
  • Sell or rent your personal information — to anyone, for any reason.
  • Store your full card number on our servers, ever.
  • Bury your return rights in fine print — Section 7 and our Returns page say exactly how returns work.
  • Make it hard to unsubscribe from marketing email — one click, honored immediately.
  • Promise something outside our control, like a brand’s exact ship time — items ship from the independent brands that stock them, not a Syfted warehouse.

1. Who We Are

Syfted is a multi-brand fashion marketplace operated by Lucas Ferry Enterprises LLC, a California limited liability company (“Syfted,” “we,” “us,” or “our”). Syfted connects buyers with independent clothing brands in one unified shopping experience — one cart, one checkout, many brands.

By accessing or using Syfted’s website (shopsyfted.com) or mobile application (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Platform.

The Platform is operated from the United States. Where Syfted delivers to an address in another country, you remain responsible for compliance with your own local laws, including any restriction on importing a particular item. Import duties and taxes on your order are calculated and collected at checkout rather than charged to you on delivery — see Section 6. Syfted does not offer the Platform in every country, and the destinations available to you at checkout are authoritative.

2. Eligibility

You must be at least 13 years old to create an account on Syfted. If you are under 13, you may not use the Platform under any circumstances. Syfted does not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will delete it promptly. Parents or guardians who believe a child under 13 has created an account should contact us at support@shopsyfted.com.

To complete a purchase, you must be at least 18 years old, or have the express consent and involvement of a parent or legal guardian who agrees to these Terms on your behalf. By completing a purchase, you represent that you meet this requirement. This restriction exists because individuals under 18 may lack the legal capacity to enter into binding contracts in most jurisdictions, and because our payment processor requires account holders to be of legal contracting age under applicable law.

By using the Platform, you represent that your use complies with all applicable laws and regulations in your jurisdiction. We reserve the right to terminate accounts or cancel orders if we have reason to believe these requirements have not been met.

3. Your Account

To access certain features, including purchasing, you must create an account. You agree to provide accurate, complete, and current information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Notify us immediately at support@shopsyfted.com if you believe your account has been compromised. Syfted is not liable for any loss resulting from unauthorized account access due to your failure to keep your credentials secure.

You may create an account using your email and password or through a supported third-party authentication provider. Sign in with Apple is available on the Syfted iOS app. When you use a third-party provider, Syfted receives limited profile information (such as a name and email address, which may be a relay address if you choose to hide your real email from Apple). Your use of a third-party provider is also governed by that provider’s own terms and privacy policy.

You may not create more than one account or transfer your account to another person. Accounts are for personal use only; bulk commercial purchasing using automated tools is prohibited. You may close your account at any time from your profile settings or by contacting us. Account deletion cannot be completed while you own an active or pending brand account, or while you have a paid order that has not yet been fulfilled; we will tell you which condition applies and complete the deletion once it is resolved.

4. How the Marketplace Works

Syfted lists products from many independent brands and sells them to you on consignment. Each brand keeps ownership of its items until you buy one; Syfted is the seller and the party to the sale contract with you, and your payment is made to Syfted. Syfted does not warehouse or take physical possession of any item — brands ship your order directly to you.

Brands are Syfted’s consignors. They photograph, describe, and price their own products, hold their own stock, and ship your order. Each brand is responsible for the accuracy of what it lists and for fulfilling and shipping the items you order from it, and Syfted relies on brands for that information and performance.

Syfted facilitates a single unified checkout across multiple brands. Each brand sets its own shipping rate — either taken from the brand’s own connected store or set by the brand directly; where your cart contains items from more than one brand, the shipping shown at checkout is the sum of those rates. Syfted does not add a margin to any brand’s shipping rate.

Brand applications may be reviewed and approved through a combination of automated screening and human review; not every application is manually reviewed by a person before a brand is approved to sell on the Platform. Approval, whether automated or manual, is not a guarantee or endorsement of any brand’s products, business practices, or legitimacy.

Because Syfted is the seller, Syfted is responsible for the sale itself, including the refund floor described in Section 7. Brands remain responsible for the quality, safety, and accuracy of the products they consign — Syfted is not a manufacturer, never takes possession of an item, and does not inspect products before they ship to you.

5. Purchases, Pricing, and Payment

All prices displayed on the Platform are set by the brands and are shown in US dollars. Prices are subject to change at any time without notice. Syfted does not guarantee the availability of any product at any listed price. Applicable taxes and shipping fees will be calculated and shown at checkout.

A single checkout is currently limited to products from a maximum of 5 brands at a time. If your cart contains items from more than 5 brands, you will need to split your order into multiple checkouts.

Payment is processed securely by Shopify, which operates the checkout your order goes through. Syfted does not collect, store, or have access to your payment card details. By completing a purchase, you authorize payment through that provider for the total amount displayed at checkout, including any applicable shipping fees, taxes, and import duties.

Currency. Syfted prices and sells in US dollars. If you are shopping from outside the United States, prices and the total may be shown to you in your local currency as a conversion for your convenience; the amount displayed at checkout is what you authorize and what you will be charged. Your bank or card issuer may apply its own foreign transaction fee or a different exchange rate, which is set by them and is outside Syfted’s control. Refunds are issued against the original transaction, so the amount that reaches you may differ slightly from what you paid if exchange rates have moved.

Your use of the payment provider’s services is also governed by their own terms — Shopify’s Terms of Service. Syfted is not responsible for payment processing errors, failures, or issues caused by that provider.

Syfted retains a consignment commission of a flat 10% of the product subtotal of each sale out of what you pay, and remits the balance to the consigning brand. Brands may also pay Syfted a subscription fee to sell on the Platform. The commission does not apply to shipping. Neither is charged to you as a buyer on top of the listed price.

Shipping is charged at cost and is not discounted for multi-brand orders. Each brand in your cart sets its own shipping rate and ships your items separately, so the shipping total shown at checkout is the sum of every brand’s rate and is itemized per brand before you pay.

A brand’s rate may come from the brand’s own connected store, in which case it can vary with the value or weight of that brand’s items in your cart — for example a brand may ship free above a certain order value. Where no such rate applies, the brand’s own flat rate is used. Any shipping figure shown before checkout is an estimate. The amount you are charged is the amount itemized on the checkout page, which is calculated at that point and is the only figure that binds.

As the seller of the items you purchase (Section 4), Syfted calculates, collects, and remits sales tax on your purchase where required by law. Where tax calculation is enabled for your checkout method, it is calculated at checkout based on your shipping address and collected by Syfted on behalf of the applicable taxing authority. Tax calculation is not currently enabled on every checkout method, so the amount of tax shown at checkout may be zero; where that is the case, any tax obligation on the transaction remains yours to settle directly with the relevant authority. Any sales tax we do collect is not revenue to Syfted and is remitted to the appropriate government entity.

Returns and refunds are governed by Section 7 and by our Return & Refund Policy, which set out both the refund Syfted provides regardless of any brand’s policy and the discretionary returns each brand sets for itself. Nothing in these Terms limits any non-waivable right you have under the consumer-protection law of your own jurisdiction. If a payment is declined or reversed, Syfted reserves the right to cancel the associated order. In the event of a clear pricing error, Syfted may cancel your order and issue a full refund. Nothing in these Terms limits any rights you may have to dispute a charge with your payment card issuer as permitted by applicable law and your cardholder agreement.

6. Shipping and Fulfillment

Shipping availability is determined by each individual brand and by where Syfted is able to sell. Not all brands ship to all locations, and your cart can only ship somewhere every brand in it ships to. The shipping destinations supported at checkout are authoritative, and are subject to change as brands and platform capabilities expand.

International orders, duties, and import taxes. Where an order crosses an international border, import duties and taxes are calculated and collected at checkout as part of the total you pay, and nothing further is payable on delivery. The parcel travels Delivered Duty Paid, on a prepaid label Syfted provides to the brand, and Syfted is responsible for remitting those amounts to the destination country. The shipping charge shown at checkout for such an order includes them. If a carrier nevertheless asks you for import duties or taxes on a parcel bought through Syfted, contact us and do not pay twice — that is a mistake and we will resolve it.

This does not cover charges that are not import duties or taxes: a storage fee for a parcel you did not collect, a redelivery charge, or a penalty arising from information you gave incorrectly at checkout remain yours. A parcel refused or abandoned at customs is treated as a return under Section 7, and any charges incurred may be deducted from a refund.

Each brand is solely responsible for fulfilling and shipping their own products. Shipping timelines, carriers, costs, and tracking information vary by brand. Each brand sets its own shipping rate and you are charged the sum of those rates, so a multi-brand order costs more to ship than a single-brand one. A brand’s rate may be read from that brand’s own store and may therefore depend on the value or weight of its items in your cart. Syfted does not set, verify, or guarantee any brand’s shipping rate, and does not guarantee any specific delivery timeframe, carrier, or shipping outcome.

Syfted may apply a short holding period to an order after payment, during which the brand is not yet able to begin fulfilling it. This is a standard marketplace protection that gives us a window to detect payment or address problems before an order is picked and packed. No such holding period is currently applied to orders; where one is, the period is brief and is included in the delivery timeframes brands quote, and it does not affect your right to cancel or to a refund.

If you order from multiple brands in a single checkout, you may receive multiple separate shipments. Syfted does not choose the carrier or the shipping method, does not guarantee a delivery date, and has no ability to intervene in, redirect, or recover a shipment once a brand has dispatched it, and is not liable for a delay attributable to a carrier. None of that limits Section 7: an item that never arrives, arrives damaged, or arrives as the wrong item is refunded by Syfted directly, and you deal with Syfted rather than with the brand or the carrier.

Product Drops: The Platform features limited-release product drops announced by individual brands. Drop schedules, availability, quantities, and pricing are determined solely by each brand. Syfted does not guarantee that any drop will occur as scheduled, that any product will be available when a drop goes live, or that subscribing to drop notifications will result in a successful purchase. Brands may change, postpone, or cancel drops at any time without notice. Syfted is not responsible for missed drops, sellouts, scheduling changes, or notification delivery failures.

7. Returns and Refunds

Because Syfted is the seller of the items you purchase (Section 4), Syfted — not the brand — issues your refund. For an item that is defective, materially different from its listing, or never delivered, Syfted will refund you directly; contact us at support@shopsyfted.com and we’ll take it from there.

For all other returns and exchanges — sizing, change of mind, and similar — the brand that consigned the item sets its own policy, including eligibility windows and conditions, and the item goes back to that brand. Contact the brand first; once they confirm a return is accepted, Syfted processes your refund. We encourage you to review a brand’s return terms before completing a purchase.

International returns. Where your order shipped outside the United States, returning it means sending it back across a border, and the cost of return shipping is yours unless the item was defective, damaged, or not what you ordered. Import duties and taxes are collected at checkout rather than on delivery and are not refunded by Syfted; depending on your country you may be able to reclaim them from your own customs authority, and Syfted will provide the order documentation you need in order to try. A parcel refused at customs, or left unclaimed and returned, is treated as a return: Syfted refunds what you paid for the item, less any duties, carrier charges, storage, or return costs actually incurred. This paragraph does not apply where the item was defective, damaged, or not what you ordered, which Syfted refunds in full.

The 30-day hold on Syfted Points described in Section 24 is a term of the Points program and does not create, imply, or extend any return or refund right.

8. User Content

Syfted allows you to submit content on the Platform, including product reviews and ratings (“User Content”). By submitting User Content, you grant Syfted a non-exclusive, worldwide, royalty-free, sublicensable, perpetual license to use, display, reproduce, modify, and distribute that content in connection with operating and promoting the Platform.

Reviews and ratings may only be submitted by users who have completed a paid order on Syfted that includes the product being reviewed. This verified-purchase requirement exists to ensure that reviews reflect genuine purchase experiences. Syfted verifies purchase status automatically at the time of submission; reviews submitted before a payment is confirmed will not be accepted.

You represent and warrant that your User Content is accurate, is your own original work or that you have the right to submit it, and does not violate any third-party rights or applicable law. You are solely responsible for your User Content.

Syfted does not endorse any User Content and makes no representations about its accuracy, completeness, or reliability. Reviews reflect the opinions of individual users, not the views of Syfted. Syfted reserves the right — but has no obligation — to review, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

If you are a California resident under the age of 18 and have a registered Syfted account, you may request removal of User Content you have publicly posted by contacting us at support@shopsyfted.com. We will use commercially reasonable efforts to remove the content from public view, though we cannot guarantee complete removal from all third-party caches or services (Cal. Bus. & Prof. Code §22581).

9. Communications

By creating an account on Syfted, you consent to receiving electronic communications from us. These include:

  • Transactional emails — order confirmations, order and shipment breakdowns explaining which brand is shipping which part of your order, shipment tracking notifications (sent when a brand adds a tracking number to your order), shipping updates, fulfillment status notices (including notices if an issue arises routing your order to a brand), and other account-related notices. These cannot be opted out of.
  • Emails from our payment and commerce providers — depending on how you pay, your payment receipt may be sent to you by the commerce platform that processes the transaction on Syfted’s behalf, rather than by Syfted directly. You may therefore receive a receipt from that provider in addition to the order emails described above. These are transactional and cannot be opted out of.
  • Activity-based emails — abandoned cart reminders, browse activity reminders, drop alerts for brands you follow, new product notifications when a brand you follow adds products to their Syfted storefront, and price-drop alerts when a product you have liked or saved drops in price by 5% or more. To support cart abandonment reminders, Syfted stores your cart contents on our servers when you are signed in.
  • Drop reminders you request — when you tap “Notify Me” on an upcoming drop and choose email, we send you at most two emails for that drop: one approximately one hour before it goes live, and one when it goes live. You choose the channel at the moment you subscribe, and we record when you did. You can cancel by tapping the button again, and unsubscribing from marketing emails stops these as well.
  • Post-purchase emails — follow-up messages after a completed order, including suggestions to follow the brands you purchased from and product recommendations based on your purchase history.
  • Re-engagement emails — periodic emails if you have not visited the Platform in some time, intended to notify you of new products or brands.
  • Welcome emails — a series of emails sent when you first create an account introducing you to the Platform.
  • Brand account emails — if you register as a brand, you will receive emails related to your brand account. Application approval or rejection notices and new order notifications are transactional and cannot be opted out of. A weekly digest summarizing your sales activity is also sent; the weekly digest is not transactional and may be stopped by contacting us at support@shopsyfted.com.
  • Brand billing emails — if you register as a brand, you will receive notices about your seller subscription: a reminder 14 days before your free trial ends, a reminder 3 days before it ends, a notice when your trial or payment lapses and a grace period begins, a notice if your storefront is hidden for non-payment, a notice when Drop Friendly billing pauses your subscription because nothing has been live, and a notice when it resumes and a new period is charged. These are transactional and cannot be opted out of while you have an active brand account.

You may opt out of all non-transactional emails at any time by clicking the unsubscribe link in any such email or by contacting us at support@shopsyfted.com. Opting out of marketing emails does not affect transactional emails related to purchases you have made.

You may manage push notification preferences through your device settings at any time.

If you register as a brand on Syfted and provide a phone number, you consent to receiving SMS notifications from us regarding your brand account, including new order alerts and application status updates. Standard message and data rates may apply. You may opt out of SMS notifications by replying STOP to any message or contacting us at support@shopsyfted.com.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use automated tools (bots, scrapers, crawlers) to access, collect, or interact with the Platform without our prior written consent
  • Use automated or bulk purchasing tools to acquire inventory for commercial resale purposes
  • Attempt to gain unauthorized access to any part of the Platform, including other user accounts or Syfted’s systems
  • Interfere with or disrupt the operation of the Platform or the servers and networks connected to it
  • Post, transmit, or submit any User Content that is harmful, threatening, defamatory, obscene, infringing, or otherwise objectionable
  • Submit false, misleading, or fraudulent reviews or ratings
  • Harass, threaten, or intimidate any brand, other user, or Syfted employee through any feature of the Platform
  • Engage in fraudulent activity, including submitting false payment disputes or chargebacks without legitimate basis
  • Circumvent or manipulate any feature of the Platform, including pricing or promotions

Violation of these rules may result in account suspension or termination, order cancellation, and, where applicable, legal action.

11. Intellectual Property and DMCA

The Syfted name, logo, wordmark, and all content on the Platform — including but not limited to text, images, graphics, software, and design — are owned by or licensed to Lucas Ferry Enterprises LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any Syfted content without our prior written permission. Nothing in these Terms grants you any license to use our intellectual property.

Product images, descriptions, and brand assets displayed on the Platform are provided by the respective brands. Syfted displays this content in reliance on representations from brands that they have the necessary rights and authorizations to do so. Syfted does not independently verify the ownership or licensing of brand-submitted content and is not responsible for any infringement arising from content submitted by brands.

Syfted respects intellectual property rights and complies with the Digital Millennium Copyright Act (“DMCA”). It is Syfted’s policy to terminate the accounts of users and brands who are repeat infringers of intellectual property rights. To receive DMCA takedown notices, Syfted has designated an agent whose contact information is on file with the U.S. Copyright Office. If you believe that content on the Platform infringes your copyright, please send a written DMCA notice containing the following to support@shopsyfted.com: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material and its location on the Platform; (3) your contact information including name, address, phone, and email; (4) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (6) your physical or electronic signature. We will respond to valid DMCA notices in accordance with applicable law. Knowingly submitting a false DMCA claim may expose you to liability under 17 U.S.C. § 512(f).

Counter-Notification: If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may send a written counter-notification to support@shopsyfted.com containing: (1) your physical or electronic signature; (2) identification of the content that was removed and where it appeared on the Platform before removal; (3) a statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification; (4) your name, address, and phone number; and (5) a statement that you consent to jurisdiction in the federal district court for the judicial district in which your address is located (or Los Angeles County, California, if outside the United States), and that you will accept service of process from the party who submitted the original DMCA notice. Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the content within 10–14 business days unless the complainant notifies us that they have initiated a court action to restrain the allegedly infringing activity.

12. Third-Party Services and Links

The Platform may contain links to third-party websites or reference third-party services (including but not limited to Stripe and Shopify for payment processing, and brand websites). These third-party services have their own terms of service and privacy policies, which govern your use of those services. Syfted does not control, endorse, or assume responsibility for any third-party content, services, or practices.

Your use of Shopify’s checkout is subject to Shopify’s own terms of service. Syfted is not liable for any issues arising from your interaction with third-party services, including payment failures, data breaches, or service outages outside of our control.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Syfted does not warrant that the Platform will be uninterrupted, error-free, or secure at all times. Syfted does not warrant the accuracy, completeness, or reliability of any content provided by brands or users, including product descriptions, sizing information, images, pricing, or reviews.

Syfted is not responsible for the conduct, products, or practices of any brand on the Platform. Syfted does not verify, inspect, or guarantee that products listed by brands are authentic, safe, accurately described, or compliant with applicable consumer product safety laws. Syfted expressly disclaims any responsibility for counterfeit, recalled, mislabeled, or otherwise non-compliant products listed by brands. Your use of the Platform and any products purchased through it are at your sole risk.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LUCAS FERRY ENTERPRISES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, ANY PRODUCTS PURCHASED THROUGH THE PLATFORM, ANY BRAND’S CONDUCT OR PRODUCTS, OR ANY THIRD-PARTY SERVICES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL — WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF SYFTED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SYFTED’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID FOR THE TRANSACTION(S) GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

15. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute, you agree to first contact us at support@shopsyfted.com and give us 30 days to attempt to resolve the issue informally.

Binding Arbitration

If a dispute cannot be resolved informally, you and Syfted agree to resolve it through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. You and Syfted each waive the right to a jury trial and the right to participate in any class action lawsuit or class-wide arbitration.

Arbitration will be conducted in Los Angeles County, California, or via videoconference at either party’s request. The arbitrator’s decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, nothing in this arbitration provision prevents either party from seeking public injunctive relief in a court of competent jurisdiction to the extent required by applicable law.

Delegation

Threshold questions of arbitrability — including whether a dispute is subject to arbitration and the scope and enforceability of this arbitration agreement — are to be decided by the arbitrator, not a court, except that the enforceability of the class-action waiver in this section is a question for a court to decide.

Mass Arbitration

If 25 or more similar arbitration demands are filed against Syfted by or with the assistance of the same law firm or coordinated group (“Mass Demands”), the AAA’s Mass Arbitration Supplementary Rules will apply. Mass Demands will be batched into groups of no more than 25 demands per batch and resolved in staged proceedings, with each batch completing before the next begins. This batching process is intended to reduce AAA administrative fees and promote efficient resolution. The statute of limitations is tolled for all Mass Demands during the batching process.

Arbitration Opt-Out

You may opt out of binding arbitration within 30 days of the date you first created your Syfted account. To opt out, send a written notice to support@shopsyfted.com with the subject line “Arbitration Opt-Out” and your full name and account email address. If you opt out, disputes will be resolved exclusively in the state courts of Los Angeles County, California, or the United States District Court for the Central District of California (Los Angeles Division), and you consent to personal jurisdiction in those courts.

Small Claims Court

Notwithstanding the above, either party may bring an individual claim in small claims court in Los Angeles County, California, if the claim qualifies.

16. Indemnification

You agree to indemnify, defend, and hold harmless Lucas Ferry Enterprises LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform; (b) any User Content you submit; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property rights.

17. Force Majeure

Syfted shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, internet outages, third-party service failures, or any other event outside of Syfted’s reasonable control.

18. Changes to These Terms

Syfted may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you by email or in-app notice. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree to the updated Terms, you must stop using the Platform.

19. Termination

Syfted may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Platform immediately ceases. You may close your account at any time by contacting us.

Sections 5, 8, 10, 11, 13, 14, 15, 16, 17, 20, 21, 23, and 24 of these Terms will survive any termination or expiration.

20. Miscellaneous

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Syfted regarding your use of the Platform as a buyer and supersede all prior agreements on the same subject matter. Brands that sell through the Platform are additionally governed by the Brand & Seller Agreement, which controls in the event of any conflict between that agreement and these Terms on brand-specific matters.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Syfted’s failure to enforce any right or provision shall not constitute a waiver of that right or provision. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Syfted.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Syfted may assign these Terms without restriction.

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (“CCPA”). Please see our Privacy Policy for details.

21. Apple App Store

If you download or access the Syfted mobile application through the Apple App Store, the following additional terms apply:

  • These Terms are an agreement solely between you and Lucas Ferry Enterprises LLC, not with Apple Inc. (“Apple”). Apple is not responsible for the Syfted app or its content.
  • The license granted to you under these Terms is limited to a non-transferable right to use the Syfted app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation whatsoever to provide any maintenance or support services for the Syfted app. Any support questions should be directed to us at support@shopsyfted.com.
  • In the event of any failure of the Syfted app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the Syfted app, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country subject to a U.S. government embargo or that has been designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

22. Accessibility

Syfted is committed to making the Platform accessible to users with disabilities. We work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a target standard for the web application. If you encounter accessibility barriers on the Platform or need an accommodation to use any feature, please contact us at support@shopsyfted.com and we will work with you to provide appropriate assistance. This is an ongoing effort and we continue to make improvements over time.

23. Export Compliance and Sanctions

The Platform is operated from the United States and is available only in the countries Syfted offers at checkout. By using the Platform, you represent and warrant that: (a) you are not located in, and are not a resident or national of, any country subject to a U.S. government embargo or comprehensive sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); (b) you are not identified on any U.S. government restricted-party list, including the Office of Foreign Assets Control (“OFAC”) Specially Designated Nationals and Blocked Persons List; and (c) you will not use the Platform in any manner that would violate applicable U.S. export control or sanctions laws. Syfted reserves the right to restrict access to the Platform from any jurisdiction, at any time, without notice.

24. Syfted Points

Syfted Points is an optional rewards program available to registered account holders. Participation is free and requires no action to enroll.

Earning

You earn 1 point for every $1 of the product subtotal on a completed order, rounded down to the nearest whole point. Points are not earned on shipping, on taxes, or on any portion of an order paid for with points. Syfted may also issue promotional or goodwill points at its discretion.

30-day hold before points can be used

Points earned on a purchase become redeemable 30 days after the order date. Until then they appear in your account as pending. This hold is a term of the Points program, adopted to protect the program from abuse. It is not a return window and does not create, imply, or extend any return or refund right — returns remain governed by the individual brand’s policy as described in Section 7.

Membership tiers

The Points program has four tiers. Your tier is determined by the total number of points you have earned over the life of your account (your “lifetime earned points”), not by your current balance — spending points never reduces your tier. Because points are earned at one point per $1 of product subtotal, the thresholds below also correspond to lifetime product spend.

Your tier is applied at the moment you redeem, to your whole balance. Points earned at a lower tier are redeemed at your current tier’s value; we do not track a separate value per point. Tiers do not expire or decay with time. Your lifetime earned points can decrease only where points are reversed because an order was refunded or cancelled, as described below, which may return you to a lower tier.

Redeeming

Points are redeemed for money off an order at your tier’s value, shown in the table above and in your account. A redemption must be worth at least $2.00 — that is 200 points at Bronze, and fewer at higher tiers, because the minimum is a dollar amount rather than a fixed number of points. There is also a maximum amount that may be applied to any single order. That maximum is a dollar amount, is the same at every tier, varies by order, and is shown to you at checkout before you pay; on some orders it may be zero. A higher tier therefore does not increase how much you can take off one order — it means fewer of your points are consumed to reach that amount. Points have no cash value, cannot be exchanged for cash, cannot be transferred or sold, do not constitute property, and are not a stored value or gift card instrument.

Expiration and inactivity

Points expire 18 months after your last account activity. For this purpose, activity means a completed purchase or a redemption of points. Browsing, signing in, and other engagement do not extend the expiration date. Points are forfeited without compensation if your account is closed by you or terminated by Syfted under Section 19.

Refunds and cancellations

If an order is refunded or charged back, the points earned on that order are reversed. Points you already redeemed on a separate order are not reclaimed — you keep the discount you received. If a checkout that included a points redemption is cancelled or fails, the points are returned to your balance.

Changes to the program

Syfted may modify the earn rate, redemption value, tier thresholds, the number of tiers, minimum balance, per-order maximum, hold period, or expiration rules, or discontinue the Points program entirely, at any time. Where a change materially reduces the value of points you have already earned, we will provide notice as described in Section 18 and a reasonable opportunity to redeem your existing balance. Syfted may suspend or cancel points, and may suspend participation in the program, where we reasonably believe there has been fraud, abuse, or a violation of these Terms.
