DMCA Takedown Notices
Syfted respects intellectual property rights and responds to notices filed under the Digital Millennium Copyright Act (“DMCA”).
Where notices go
Syfted is in the process of registering a designated agent with the U.S. Copyright Office, as required by 17 U.S.C. § 512(c)(2). Until that registration is complete, send your notice to the contact below and it will still be received, recorded, and acted on — the registration governs Syfted’s own safe-harbour protection, not whether a notice sent here is honored.
Email support@shopsyfted.com with the subject line “DMCA Notice”, or use the form at the bottom of this page — both reach the same queue.
What a notice must include
Product images, descriptions, and brand assets on Syfted are submitted by the independent brands on the marketplace, and Syfted displays them in reliance on each brand’s representation that it holds the rights to do so. If you believe content on Syfted infringes your copyright, send a written notice containing all of the following — a notice missing any of these is not one we can act on as a valid DMCA notice:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the infringing material, and its location on the Platform — the exact product or brand page URL.
- Your contact information: name, postal address, telephone number, and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner, or are authorized to act on the owner’s behalf.
- Your physical or electronic signature.
Once we receive a compliant notice, we act on it expeditiously — removing or disabling access to the identified material.
Counter-notification
If content you submitted was removed because of a DMCA notice and you believe that was a mistake or misidentification, you may send a written counter-notification to the same address, containing: (1) your physical or electronic signature; (2) identification of the material that was removed and where it appeared before removal; (3) a statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification; (4) your name, address, and phone number; and (5) a statement that you consent to the jurisdiction described in our Terms of Service §11, and that you will accept service of process from the person who filed the original notice.
On receipt of a valid counter-notification, we forward it to the original complainant and may restore the material within 10–14 business days unless we are notified that the complainant has filed a court action to restrain the activity. A takedown process with no counter-notice is a removal with no appeal, so we keep this path open to anyone whose content was removed in error.
Before you file
Knowingly submitting a false or materially misleading DMCA notice or counter-notification can expose you to liability, including damages and attorneys’ fees, under 17 U.S.C. § 512(f). Only file a notice if you are the copyright owner, or are authorized to act on the owner’s behalf, and you have a good-faith basis for every statement in it.
Repeat infringers
It is Syfted’s policy to terminate the accounts of users and brands who are repeat infringers of intellectual property rights.
What we do with the information in your notice
A valid notice has to contain your name, postal address, telephone number, email address and signature — the law requires them, not us. We store what you submit, along with the IP address it came from, so that the notice is a queue a person works rather than an email that can be missed. We may share it, including your contact details, with the brand whose listing you have named, and we forward a valid counter-notification to you as described above. We do not create an account for you and we do not add you to any mailing list.
We keep notices indefinitely, because the notice and what we did about it is the record that we handled it correctly. Full detail, including how to ask us to correct or remove one, is in Sections 1 and 5 of our Privacy Policy.
