Prohibited Items Policy

Syfted is a curated multi-brand fashion marketplace. All brands approved to sell on Syfted agree to our Brand & Seller Agreement, which includes obligations around product quality, authenticity, safety, and regulatory compliance. This Prohibited Items Policy specifies the categories of products that brands may not list on the Platform under any circumstances.

Syfted reserves the right to remove any listing that violates this policy, without notice, and to suspend or terminate the brand account responsible. The categories below are not exhaustive — Syfted may prohibit additional items at its sole discretion.

1. Counterfeit and Infringing Products

Brands may not list:

  • Counterfeit goods — products that copy or imitate the trademark, trade dress, or branding of another brand without authorization, including fake designer labels, replicas, and knockoffs.
  • Products that infringe any third-party copyright, trademark, patent, trade secret, or other intellectual property right — including unauthorized use of licensed characters, sports team logos, band names, or artist imagery on apparel or accessories.
  • Products sold under a brand name or using imagery that the seller does not own or have a valid license to use.

2. Recalled and Unsafe Products

Brands may not list:

  • Any product subject to an active recall by the U.S. Consumer Product Safety Commission (CPSC) or any other applicable regulatory authority.
  • Products that fail to meet applicable federal or state consumer product safety standards, including flammability requirements for children’s sleepwear and other CPSC-regulated product categories.
  • Products that contain materials known to be hazardous to health and banned or restricted under applicable law (such as certain lead-containing components in children’s products).
  • Products with defects or manufacturing flaws that create an unreasonable risk of injury.

3. Mislabeled and Misrepresented Products

Brands may not list:

  • Products with inaccurate, false, or materially misleading descriptions, images, or product titles.
  • Apparel and textile products that do not comply with the Textile Fiber Products Identification Act or the Wool Products Labeling Act — including products missing required fiber content labels.
  • Products that falsely claim to be made in the USA, handmade, sustainable, organic, or any other attribute that the product does not genuinely possess.
  • Products listed at prices that are artificially inflated to create a false sense of discount.

4. Illegal and Regulated Items

Brands may not list:

  • Any item whose sale, distribution, or importation is prohibited or restricted under applicable U.S. federal or state law.
  • Products manufactured using forced, child, or otherwise illegal labor in violation of applicable law.
  • Products subject to U.S. export control restrictions or sanctions that cannot lawfully be sold domestically to sanctioned parties.
  • Items imported in violation of U.S. Customs and Border Protection regulations or that infringe trade restrictions on goods from embargoed countries.

5. Hazardous Materials

Brands may not list:

  • Products containing hazardous substances that cannot be legally shipped via standard carrier networks.
  • Items containing restricted chemicals banned or regulated under applicable environmental or health statutes, including California Proposition 65-listed substances in concentrations exceeding legal limits without required warnings.

6. Weapons and Dangerous Items

Syfted is a fashion marketplace. Brands may not list weapons, firearm accessories, ammunition, knives intended as weapons, or any item whose primary purpose is to cause harm. This restriction applies regardless of whether the item is legal to sell in the seller’s jurisdiction.

7. Adult and Obscene Content

Brands may not list:

  • Sexually explicit or obscene products or products displaying sexually explicit imagery.
  • Products depicting or promoting hate, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Products targeting or designed for use by minors that contain adult content.

8. Stolen and Misappropriated Goods

Brands may not list items that are stolen, misappropriated, or acquired through fraudulent means. Syfted cooperates with law enforcement in investigations involving stolen goods sold through the Platform.

9. Items Outside Syfted’s Category Scope

Syfted is a clothing and fashion accessories marketplace. Brands may only list items that fall within Syfted’s approved product categories, which currently include apparel, footwear, bags, jewelry, and fashion accessories. The following are not permitted regardless of legality:

  • Food, beverages, or consumables
  • Electronics or technology products
  • Digital goods or downloadable content
  • Services or subscriptions
  • Pharmaceuticals, supplements, or personal care products not directly related to fashion
  • Furniture, home goods, or non-wearable lifestyle products

Syfted may update the list of approved categories over time. Brands will be notified of category changes that affect their existing listings.

Reporting a Prohibited Item

If you encounter a listing on Syfted that you believe violates this policy, please report it to us at support@shopsyfted.com with the subject line “Prohibited Item Report” and a link to or description of the listing. We take all reports seriously and investigate promptly.

To report a copyright or trademark infringement specifically, please follow the DMCA notice procedure described in our Terms of Service §11.
